TERMS OF SERVICE

By accessing or using VibeAiVerse you agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms that apply to specific features or services. If you do not agree to these terms, please do not use VibeAiVerse. Your continued use of the platform after any modifications to these Terms constitutes your ongoing acceptance of those changes.

You must be at least 18 years old to create an account on VibeAiVerse. By using VibeAiVerse, you represent and warrant that you are 18 years of age or older and have the full legal authority to enter into and be bound by these Terms. Accounts found to belong to users under 18 will be terminated immediately.

VibeAiVerse offers the following account tiers: Listener (free), Listener Plus, Creator Free, Creator Pro, and Creator Elite. Each tier provides different features, upload limits, and revenue-sharing terms as described in our current pricing documentation. VibeAiVerse reserves the right to modify, add, or discontinue any account tier with reasonable notice.

VibeAiVerse is an AI-generated music platform exclusively. All audio content uploaded to VibeAiVerse must be created in whole or in part using artificial intelligence tools. Human-only performances, live recordings, or traditional productions are not permitted. By uploading content you attest that AI tools were meaningfully involved in its creation.

By uploading content, you represent and warrant that: (a) you own or have obtained all necessary rights to the content; (b) the content was generated using AI tools in accordance with our AI Music Only Policy; (c) the content does not infringe on any third-party intellectual property rights; and (d) you grant VibeAiVerse a non-exclusive, worldwide, royalty-free licence to host, stream, display, and promote your content on the platform.

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe that content on VibeAiVerse infringes your copyright, please submit a compliant DMCA takedown notice to legal@vibeaiverse.com. We will respond to valid notices promptly. Counter-notices and repeat-infringer policies are administered in accordance with the DMCA.

Creators who upload content containing explicit lyrics, adult themes, or graphic imagery must designate that content as explicit using the provided tagging mechanism at the time of upload. Failure to properly label explicit content may result in removal of that content, suspension of upload privileges, or account termination at VibeAiVerse's sole discretion.

You may not upload, distribute, or otherwise make available content that: contains hate speech or incitement to violence; harasses, threatens, or doxes any individual; constitutes or depicts child sexual abuse material; violates any applicable local, national, or international law; or promotes fraud, deception, or illegal activity. VibeAiVerse reserves the right to remove prohibited content and terminate associated accounts without prior notice.

Eligible creators receive monthly payouts calculated on verified stream counts during the preceding calendar month. Payouts are processed via Stripe on or around the 1st of each month, subject to a minimum threshold. Creator Pro subscribers retain 70% of gross revenue attributable to their streams; Creator Elite subscribers retain 80%. VibeAiVerse retains the remainder as a platform fee. Payout rates and thresholds are subject to change with 30 days' notice.

Subscription fees are charged on a recurring monthly or annual basis depending on your selected plan. You authorise VibeAiVerse to charge your payment method on each renewal date. You may cancel at any time; cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time except where required by applicable law.

Eligible Creator Pro and Creator Elite subscribers may create multiple artist and producer profiles within a single account, subject to the limits of their respective tier. Each profile must independently comply with these Terms. You are solely responsible for all activity on all profiles associated with your account.

Users may report content they believe violates these Terms using the in-platform reporting tools. We review all reports and take action we deem appropriate, which may include content removal, account suspension, or termination. Abuse of the reporting system — including filing false or bad-faith reports — may itself result in account suspension.

VibeAiVerse may suspend or permanently terminate your account at any time for violation of these Terms, suspicious activity, fraudulent behaviour, or for any other reason at our sole discretion, with or without prior notice. Upon termination your right to access and use the service ceases immediately. Provisions of these Terms that by their nature should survive termination will continue to apply.

VibeAiVerse is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free from harmful components. We expressly disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by applicable law, VibeAiVerse, its operators, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from or related to your use of or inability to use the service, even if advised of the possibility of such damages.

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the service shall be resolved through binding individual arbitration administered by the American Arbitration Association, except where prohibited by applicable law. Class actions are waived to the extent permitted by law.
